Terms & Conditions

These Terms & Conditions are an agreement between you and Warm Regards Studios Pty Ltd ("Warm Regards", "we", "us"), a company registered in Victoria, Australia (ABN 78 695 091 993; ACN 695 091 993), which operates warm.regards.studio. You agree to these terms by using this website, submitting a project enquiry, downloading a resource, joining a waitlist or otherwise interacting with the site. If you do not agree, do not use warm.regards.studio.

Eligibility and authority

You must be at least 16 years old to use this website. If you use it or submit an enquiry on behalf of a business or another organisation, you confirm that you are authorised to act for and bind that organisation to these terms.

Studio services and project engagements

The website is a place to learn about Warm Regards and start a conversation. It does not itself create a client engagement or oblige either party to proceed with a project. If we work together, the scope, deliverables, fees, timing, approvals, intellectual-property position and any project-specific terms will be set out in a written proposal, statement of work or agreement. If there is any inconsistency, that project-specific agreement prevails over these website terms.

Enquiries and communications

You may use the enquiry form or contact us directly to discuss potential work. Please provide accurate information and do not send material that is unlawful, infringing, defamatory, harmful or confidential unless we have agreed in writing to receive it. An enquiry, discussion, estimate or availability indication is not a binding offer, quote or commitment unless we confirm it in writing.

Learning resources and third-party platforms

We may offer free resources, learning material or links to third-party platforms such as Gumroad, Skool and social networks. Access to, purchases from, or accounts on those independent platforms are governed by their own terms, privacy policies, prices, payment processes and refund rules. Warm Regards does not process payment-card details through this website.

Intellectual property

Unless we say otherwise, the website, its design, copy, visual material, videos, tools, resources, trade marks and branding are owned by or licensed to Warm Regards and are protected by intellectual-property laws. You may view and use the site for your own lawful, personal or internal-business purposes. You must not copy, reproduce, republish, sell, scrape, reverse engineer or exploit site material without our prior written permission. Project-specific ownership and licence terms are dealt with in the relevant project agreement.

AI-assisted production

Warm Regards may use AI-assisted tools as part of a broader creative and production workflow. AI output can be variable and may be subject to third-party tool terms, technical limits and evolving legal treatment. We do not promise that any AI-generated or AI-assisted output will be unique, error-free, available for every intended use, or free from third-party rights claims. You are responsible for approving final deliverables and, unless a written project agreement expressly states otherwise, for obtaining any legal, regulatory, talent, location, brand or platform clearances required for your intended use. Nothing on this site is legal, copyright or regulatory advice.

Acceptable use

You must not use the site in a way that interferes with its operation or security, attempts to obtain unauthorised access, introduces malicious code, harvests personal information, infringes another person's rights, or breaches applicable law. We may restrict access where reasonably necessary to protect the site, our business or other users.

Disclaimers

The site and its content are provided for general information and inspiration. While we try to keep them current and useful, we do not warrant that the site will always be available, accurate, complete, secure or suitable for your particular purpose. You should obtain independent professional advice before relying on information about legal rights, intellectual property, compliance, finance or any other specialist matter.

Liability

To the maximum extent permitted by law, Warm Regards is not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, opportunity or goodwill arising from use of this website or reliance on its content. Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law. Where liability for this website cannot be excluded, our total aggregate liability is limited to AUD $100. Any liability relating to a paid project is governed exclusively by the applicable project agreement.

Indemnity

To the maximum extent permitted by law, you indemnify Warm Regards and its officers, employees and contractors against claims, losses, liabilities, costs and expenses arising from your unlawful use of the website, your breach of these terms, or material you submit that infringes another person's rights. This does not apply to the extent a claim arises from our own breach of law, negligence or wilful misconduct.

Privacy

Our handling of personal information is explained in our Privacy Policy. By using the site or submitting an enquiry, you acknowledge that we may handle your information in accordance with that policy.

Governing law

These terms are governed by the laws of Victoria, Australia. The courts of Victoria have non-exclusive jurisdiction, subject to any mandatory consumer protections that apply where you live. If you have a question or concern, contact us at warm@regards.studio and we will try to resolve it directly.

Changes and termination

If we update these terms, the new version will be live here. A dated copy of the previous version will be available in the document history below. If there are no archived versions, nothing has changed since the writing of this original document. We may suspend or discontinue any part of the site at any time. These terms continue to apply to any use you made before suspension or discontinuance.

General

If any part of these terms is unenforceable, it will be read down or severed to the extent necessary and the rest remains in effect. A failure to enforce a right is not a waiver of it. You may not assign these terms without our written consent. We may assign them as part of a sale, restructure or transfer of the business on notice to you. We are not responsible for a delay or failure caused by events beyond our reasonable control.

Accessibility

Warm Regards works toward making warm.regards.studio usable by as many people as possible, including people who use assistive technology. We use WCAG 2.2 Level AA as the standard we work toward when designing, building and updating the website. The site includes visual work, video and links to third-party platforms, so some material may not yet have every accessibility alternative and third-party services are outside our direct control. If you find a barrier or need information in another format, email warm@regards.studio with the page you were using and what you were trying to do. We will acknowledge your message within 5 business days and aim to respond within 30 days.
